Das Gericht hat entschieden, dass die Deckenleuchte Prism von Zenium nicht D65-konform ist, entgegen deren Werbung. Des Weiteren hat das Gericht festgestellt, dass die Norm D65 f\u00fcr Zahn\u00e4rzte wichtig ist.<\/h3>\n

Das Berufungsgericht Nancy hat mit Beschluss vom 20. Januar 2016 die einstweilige Verf\u00fcgung vom 24. November 2014 des Handelsgerichts Nancy gegen die Firma ZENIUM best\u00e4tigt. Bei dem Prozess zwischen Degr\u00e9 K und Zenium ging es um die irref\u00fchrende Werbung von Zenium und die Behauptung, dass deren Lampe Prism die normativen Anforderungen des D65-Tageslichts erf\u00fcllt.<\/p>\n

Seit \u00fcber einem Jahr ist Degr\u00e9 K, deren Deckenleuchte Alb\u00e9do LED D65 offiziell D65-zertifiziert ist, unlauterer Konkurrenz ausgesetzt. Der Vertrieb und die Zahn\u00e4rzte werden get\u00e4uscht. Zenium tritt weiterhin den vollstreckbaren Gerichtsbeschluss mit F\u00fc\u00dfen.<\/p>\n

Nicht aus kommerziellen Motiven, sondern ausschlie\u00dflich im Namen der Ethik h\u00e4lt es Degr\u00e9 K f\u00fcr inakzeptabel, Zahn\u00e4rzte und Vertrieb \u00fcber die Qualit\u00e4t von Beleuchtungsmitteln und eventuelle Risiken zu t\u00e4uschen, denen Zahn\u00e4rzte ausgesetzt sind, die sich mit LED-Leuchten ausstatten, die f\u00fcr ihre Arbeitsbedingungen ungeeignet sind.<\/p>\n

Der Beschluss hat best\u00e4tigt, dass es f\u00fcr Zahn\u00e4rzte wichtig ist, Leuchtmittel zu verwenden, die D65-konform sind, und Zenium bei Androhung eines Zwangsgelds von 500 Euro je festgestelltem Versto\u00df untersagt, das Produkt Prism zum Verkauf anzubieten, vorzustellen oder zu vertreiben und dabei schriftlich oder m\u00fcndlich, in den Medien und auf jede andere Weise zu behaupten, dass ihr Produkt dem Lichtzertifikat D65 entspricht.<\/p>\n","protected":false},"excerpt":{"rendered":"
